Lumbre, la última luz Terms of Use

This is a courtesy translation. The Spanish version is the legally binding one and prevails in case of any difference.

1. Who offers you the game

Lumbre, la última luz (“Lumbre”) is a game by Lopand Game Studio, the video game studio of Lopand Solutions S.A. de C.V., with its address at Vicente Guerrero 132, Colonia Santa Anita, C.P. 45600, Tlaquepaque, Jalisco, México. Contact: soporte@lopandsolutions.com. In these terms we call the company "we" or "us", and we call you "you".

By downloading or playing Lumbre you accept these terms. If you don't agree with any of them, don't use the game. The terms of the store you download it from (Google Play or the App Store) also apply.

2. What you can do with the game

We give you a personal, non-exclusive and non-transferable license to install and play Lumbre on your devices, for your own use and not for a business. The license lasts as long as you comply with these terms.

You can record and stream your runs, and publish reviews, screenshots and videos of the game, even if they earn you money. You can also use the material in our press kit for that.

3. Price and purchases

Downloading Lumbre is free and it has no ads. The whole coast can be played without paying. Inside the game you can buy, with real money: Lumbre completo (it unlocks the rest of the journey), looks that only change how the lamplighter looks, a tip for the studio and a bundle with everything. Nothing you buy makes you stronger, and there are no loot boxes. Prices including taxes are shown by the store before you pay.

Every purchase stays with your store account for good: if you switch phones or reinstall, use "Restaurar compras" (restore purchases) in the game's shop. Payment is charged by Google Play (or the App Store) under their own terms. If something you paid for never arrives, write to us.

4. Refunds

Refunds are handled by the store under its policy (on Google Play, for example, you can request one from your order history). If you have a problem with a purchase, also write to us at soporte@lopandsolutions.com and we'll help. This does not limit your rights under the Federal Consumer Protection Law (Ley Federal de Protección al Consumidor).

5. Scrap, upgrades and progress

Scrap, embers, town upgrades and lit beacons are earned by playing and are not for sale. They are part of the game: they have no monetary value and cannot be sold, exchanged, refunded or transferred to another person.

Your progress is saved on your phone. On Android you can turn on the backup (Options › Respaldo del avance) and recover it on another phone with your code; keep that code safe, because without it we cannot give the backup back. If you didn't turn it on and you uninstall the game, clear its data or switch phones, your progress is lost and we cannot recover it because we never received it. What you bought does come back (with "Restaurar compras"), and your achievements and times in Google Play Games or Game Center stay in your account on that service.

6. Google Play Games and Game Center

Achievements and the daily challenge leaderboard work through Google Play Games (by Google) or Game Center (by Apple). Using them is optional. On the leaderboard, other players see your player name and your time according to your privacy settings on that service, which is governed by its company's terms and privacy notice.

7. What you may not do

If you cheat, the leaderboard service or we may remove your times.

8. Age and content

Lumbre is intended for people aged 13 or older. It contains fantasy violence: you shoot shadow creatures with your lamp, and they burst into sparks, with no blood. If you are a minor, play with the permission of your mother, your father or whoever looks after you, ask them before buying anything and ask them to read these terms with you.

9. Health

The game takes place at night, with flickering lights, sparks and flashes. If you have or have had photosensitive epilepsy or any discomfort with flashing lights, see a doctor before playing. In the options you can turn on "Reducir destellos" (reduce flashing) and "Noche más clara" (brighter night). Stop playing if you feel dizzy, get a headache or have eye discomfort, and take breaks from time to time.

10. Who owns what

The game, its name, its logo, its characters, its art, its music and its code belong to Lopand Solutions S.A. de C.V. and are protected by the Federal Copyright Law (Ley Federal del Derecho de Autor) and the Federal Law for the Protection of Industrial Property (Ley Federal de Protección a la Propiedad Industrial). The license in section 2 lets you play it; it does not transfer ownership of anything to you.

11. Updates and availability

We may update the game to fix bugs, add content or comply with store requirements, without taking away what you bought. We make reasonable efforts for it to work well, but we do not guarantee that it is error-free or that it will stay available in the store forever.

12. Liability

Lumbre is offered as is. We are not liable for the loss of progress saved on your phone or for indirect damages. Nothing in these terms limits any liability that the law does not allow to be limited, including willful misconduct and gross negligence, or the rights granted to you by the Federal Consumer Protection Law (Ley Federal de Protección al Consumidor).

13. Privacy

What data is processed and who processes it is explained in the Lumbre, la última luz privacy notice, which is part of these terms.

14. Changes to these terms

If we change them, we will publish the new version on this page with its date. If you keep playing after it is published, you are deemed to accept it; if you don't agree, you can stop using the game and uninstall it.

15. Governing law and disputes

These terms are governed by the laws of the United Mexican States. If you have a problem with the game, write to us first at soporte@lopandsolutions.com: almost everything gets solved that way.

As a consumer, you may go at any time to the Federal Consumer Protection Agency (Procuraduría Federal del Consumidor, PROFECO), without having written to us first. For any other dispute, the parties submit to the competent courts of Guadalajara, Jalisco, unless the law grants you the right to go to the courts where you live.
