La Botica de Almar Terms of Use
This is a courtesy translation. The Spanish version is the legally binding one and prevails in case of any difference.
1. Who offers the game
La Botica de Almar is a game by Lopand Game Studio, the video game studio of Lopand Solutions S.A. de C.V., located at Vicente Guerrero 132, Colonia Santa Anita, C.P. 45600, Tlaquepaque, Jalisco, México. Contact: soporte@lopandsolutions.com. In these terms we call it “we”, and you, “you”.
By downloading or playing La Botica de Almar you accept these terms. If you disagree with any of them, don't use the game. The terms of the store you download it from (Google Play) also apply.
2. What you can do with the game
We give you a personal, non-exclusive, non-transferable license to install and play La Botica de Almar on your devices, for your own use and not for a business. The license lasts as long as you follow these terms.
You may record and stream your games and publish reviews, screenshots and videos of the game, even if they earn you money. You can also use the material in our press kit for that.
3. Price and purchases
Downloading La Botica de Almar is free, and all 30 days of the story can be played without paying. Inside the game you can buy, with real money, a starter pack (once) and packs of essences, the game's special currency, which can also be earned through missions. Essences are for exclusive decorations, hourglasses and ingredients. There are no loot boxes: every pack says what's inside. Prices including taxes are shown in the store before you pay.
Payment is charged by Google Play under its own terms. The starter pack stays with your store account: if you change phones or reinstall, use “Restore purchases” in the game's shop. Essences are stored on your phone and can't be recovered if you uninstall the game or change phones without spending them. If something you paid for never arrives, write to us.
4. Refunds
Refunds are handled by the store under its policy (on Google Play you can request one from your order history). If you have a problem with a purchase, also write to soporte@lopandsolutions.com and we'll help. If a purchase is refunded, we may remove from the game what was delivered for it. This doesn't limit your rights under Mexico's Federal Consumer Protection Law.
5. Ads
Ads are optional: they only appear if you tap “Watch an ad” in Missions, in exchange for a gift, and at most five a day. They're served by Google AdMob, set to show non-personalized ads suitable for all ages. Nothing in the game forces you to watch them.
6. Coins, essences, items and progress
Coins, essences, hourglasses, ingredients, potions, upgrades and decorations are part of the game: they have no monetary value outside it and can't be sold, exchanged for money or transferred to someone else.
Your progress is saved only on your phone. If you uninstall the game, clear its data or change phones, it's lost, and we can't recover it because we never received it.
7. What you may not do
- Copy, sell, redistribute or publish modified versions of the game or its art, music or code.
- Decompile or reverse-engineer the game, except where the law expressly allows it.
- Trick the store or the game into giving you purchases without paying.
- Use the game for anything illegal or to harass other people.
8. Age and content
La Botica de Almar is for everyone: it has no violence, horror or offensive language. The potions are fantasy remedies. If you're a minor, ask your mother, father or guardian for permission before buying anything; Google Play may ask for their approval.
9. Health
The game has no flashes or flickering lights. In Options you can turn off vibration and reduce motion. Take breaks now and then, and stop playing if you feel dizzy or your eyes hurt.
10. Who owns what
The game, its name, logo, characters, story, art, music and code belong to Lopand Solutions S.A. de C.V. and are protected by Mexico's Federal Copyright Law and Federal Law for the Protection of Industrial Property. Art and design are by Romina López. The license in section 2 lets you play it; it doesn't transfer ownership of anything.
11. Updates and availability
We may update the game to fix bugs, add content or comply with the store. We do what's reasonable for it to work well, but we don't guarantee it's error-free or that it will stay available in the store forever.
12. Liability
La Botica de Almar is offered as is. We're not liable for the loss of progress or essences saved on your phone or for indirect damages. Nothing here limits liability that the law doesn't allow to be limited, including fraud and gross negligence, or your rights under the Federal Consumer Protection Law.
13. Privacy
The game asks for no data to identify you; purchases are processed by Google Play, the optional ads by Google AdMob, and the technical crash and usage data by Firebase. The details are in the La Botica de Almar privacy notice, which is part of these terms.
14. Changes to these terms
If we change them, we'll publish the new version on this page with its date. If you keep playing after it's published, you're understood to accept it; if you disagree, you can stop using the game and uninstall it.
15. Governing law and disputes
These terms are governed by the laws of the United Mexican States. If you have a problem with the game, write to us first at soporte@lopandsolutions.com: almost everything gets solved that way.
As a consumer you may go at any time to Mexico's Federal Consumer Protection Agency (PROFECO), without having written to us first. For any other dispute, the parties submit to the competent courts of Guadalajara, Jalisco, unless the law gives you the right to go to those of your place of residence.
