Rail Critters Terms of Use

This is a courtesy translation. The Spanish version is the legally binding one and prevails in case of any difference.

1. Who offers you the game

Rail Critters is a game by Lopand Game Studio, the video game studio of Lopand Solutions S.A. de C.V., with its address at Vicente Guerrero 132, Colonia Santa Anita, C.P. 45600, Tlaquepaque, Jalisco, México. Contact: soporte@lopandsolutions.com. In these terms we call the company "we" or "us", and we call you "you".

By downloading or playing Rail Critters you accept these terms. If you don't agree with any of them, don't use the game. The Google Play terms also apply, since that is the store you download it from.

2. What you can do with the game

We give you a personal, free, non-exclusive and non-transferable license to install and play Rail Critters on your devices, for your own use and not for a business. The license lasts as long as you comply with these terms.

You can record and stream your runs, and publish reviews, screenshots and videos of the game, even if they earn you money. You can also use the material in our press kit for that.

3. Price and purchases

Rail Critters is free and has no ads. Inside the game you can buy, with real money: two exclusives that only change how it looks (the axolotl and the luchador suit), a tip for the studio and a bundle with all three. Coins are never sold, nothing you buy makes you stronger and there are no loot boxes. Prices including taxes are shown in the store before you pay, and we will never charge you for something you already had.

Every purchase is yours for good on your store account: if you switch phones or reinstall, use "Restore purchases" in the game's shop. Payment is taken by Google Play (or the App Store) under their own terms, and refunds are handled by the store under its policy (on Google Play, from your order history). If something you paid for never arrives or you have a problem with a purchase, write to us. This does not limit your rights under Mexico's Federal Consumer Protection Law.

4. In-game coins and items

Coins, and the characters, outfits and upgrades in the coin shop, are earned by playing. They are part of the game: they have no monetary value and cannot be sold, exchanged, refunded or transferred to another person.

Your progress is saved on your phone. On Android you can turn on the backup (Help › Backup) and recover it on another phone with your code; keep that code safe, because without it we cannot give the backup back. If you didn't turn it on and you uninstall the game, clear its data or switch phones, your progress is lost and we cannot recover it because we never received it. What you bought with money does come back (with "Restore purchases"), and your achievements and scores in Google Play Games stay in your Google account.

5. Google Play Games

Achievements and leaderboards work through Google Play Games, a Google service. Using it is optional. On the leaderboards, other players see your player name and your score according to your Play Games privacy settings. That service is governed by Google's terms and privacy notice.

6. What you may not do

If you cheat, Google Play Games or we may remove your scores from the leaderboards.

7. Age

Rail Critters is intended for people aged 13 or older. If you are a minor, play with the permission of your mother, your father or whoever looks after you, ask them before buying anything and ask them to read these terms with you.

8. Health

The game has flashes, changing colors and constant motion. If you have or have had photosensitive epilepsy or any discomfort with flashing lights, see a doctor before playing. Stop playing if you feel dizzy, get a headache or have eye discomfort, and take breaks from time to time.

9. Who owns what

The game, its name, its logo, its characters, its art, its music and its code belong to Lopand Solutions S.A. de C.V. and are protected by the Federal Copyright Law (Ley Federal del Derecho de Autor) and the Federal Law for the Protection of Industrial Property (Ley Federal de Protección a la Propiedad Industrial). The license in section 2 lets you play it; it does not transfer ownership of anything to you. The Lilita One typeface belongs to its author and is used under the SIL Open Font License.

10. Updates and availability

We may update the game to fix bugs, add or remove content, or comply with store requirements, without taking away what you bought. We make reasonable efforts for it to work well, but we do not guarantee that it is error-free or that it will stay available on Google Play forever.

11. Liability

Rail Critters is a free game offered as is. We are not liable for the loss of progress saved on your phone or for indirect damages. Nothing in these terms limits any liability that the law does not allow to be limited, including willful misconduct and gross negligence, or the rights granted to you by the Federal Consumer Protection Law (Ley Federal de Protección al Consumidor).

12. Privacy

What data is processed and who processes it is explained in the Rail Critters privacy notice, which is part of these terms.

13. Changes to these terms

If we change them, we will publish the new version on this page with its date. If you keep playing after it is published, you are deemed to accept it; if you don't agree, you can stop using the game and uninstall it.

14. Governing law and disputes

These terms are governed by the laws of the United Mexican States. If you have a problem with the game, write to us first at soporte@lopandsolutions.com: almost everything gets solved that way.

As a consumer, you may go at any time to the Federal Consumer Protection Agency (Procuraduría Federal del Consumidor, PROFECO), without having written to us first. For any other dispute, the parties submit to the competent courts of Guadalajara, Jalisco, unless the law grants you the right to go to the courts where you live.
